1. Acceptance of these Terms
By registering for DMS Panel, signing in, connecting a server, or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms & Conditions and by our Privacy Policy and Refund Policy.
If you accept on behalf of a company, agency, or other organization, you represent that you have authority to bind that organization. If you do not agree, do not use the Service.
You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account.
2. Description of the Service
DMS Panel (“we”, “us”, “our”) provides a web-based control panel that lets you manage one or more remote Linux servers over SSH from a central dashboard. Capabilities may include — depending on your plan — site and application management, Git deployment, databases, mail, backups, security tooling, certificates, DNS, teams, billing, ticketing, and related features described on our Features and Pricing pages.
DMS Panel is a management layer. It does not replace your hosting provider, VPS vendor, or domain registrar. You remain responsible for the servers you connect and for any third-party services you use alongside the panel.
3. Your account
3.1 Registration
You must provide accurate account information (such as name and email) and keep it up to date. One person or organization should control each account unless you deliberately invite teammates under Organizations / Teams.
3.2 Security
You are responsible for safeguarding login credentials and for all activity under your account and under any team member seats you grant. DMS Panel requires a second factor on sign-in (email OTP or authenticator / TOTP). Optional “trust this device” lasts at most 24 hours. Notify us promptly at hello@dmspanel.app if you believe your account has been compromised.
3.3 Sessions
You can review login / session history and sign out other devices from account settings. Repeated failed logins may trigger automatic lockout or IP-based blocking.
4. Your servers, content, and credentials
4.1 Ownership
You retain full ownership of your code, files, databases, mailboxes, DNS zones, and the physical or virtual servers you connect. DMS Panel does not claim ownership of your content. We only process what is reasonably necessary to operate the panel on your behalf.
4.2 SSH access
When you connect a server, you authorize DMS Panel to authenticate over SSH (key or password) and to run management operations you or your authorized users trigger in the UI. Credentials are stored encrypted at rest — never in plaintext. You must only connect servers you are authorized to manage.
4.3 Your responsibility for actions
Actions taken through the panel — including deploys, file changes, database kills, firewall rules, mail configuration, restores, and security scans — run on your infrastructure. You and your teammates are responsible for those actions and their consequences. Always confirm destructive operations carefully.
4.4 Server-level billing
Any server-level renewal reminders or tracking inside DMS Panel are separate from your DMS Panel subscription. Payments to your hosting provider remain between you and that provider.
5. Acceptable use
You agree not to use DMS Panel (or servers managed through it) to:
- Violate applicable law, regulation, or court order
- Distribute malware, ransomware, phishing kits, or exploit tooling intended for unauthorized access
- Send unsolicited bulk email (spam) or operate open mail relays
- Host or distribute illegal content, including child sexual abuse material
- Infringe intellectual property, privacy, or other rights of third parties
- Attempt to probe, disrupt, or gain unauthorized access to DMS Panel systems, other customers, or third-party infrastructure
- Abuse rate limits, ticket systems, or referral / wallet programs
- Resell or white-label the Service in a way that misrepresents DMS Panel’s identity, unless we have agreed otherwise in writing
We may suspend or terminate accounts that violate this policy, and we may report illegal activity to authorities where required.
6. Plans, billing, and cancellation
6.1 Plans
DMS Panel offers a Lifetime Free plan and paid plans (Basic, Medium, Advance). Limits for servers, sites, databases, teams, tickets, and other resources are listed on the Pricing page. Paid plans may be billed monthly or yearly (yearly billing is discounted relative to monthly).
6.2 Prices
Prices are shown in Indian Rupees (INR) unless stated otherwise. We may change prices with reasonable notice; a price change does not retroactively alter an already-paid billing period.
6.3 Payment methods
Card and payment data are processed by our payment gateway. We store payment-method tokens and limited metadata (such as last four digits) — not full card numbers.
6.4 Cancellation
You may cancel a paid subscription at any time from account settings. Access continues through the end of the paid period; afterward your account falls under Lifetime Free limits. Cancellation does not entitle you to a refund of unused time — see the Refund Policy.
6.5 Plan changes
Upgrades and downgrades follow the rules shown in-product. Downgrades typically take effect at the next billing cycle. If a downgrade would exceed the lower plan’s resource limits, you may need to reduce usage before the change can complete.
7. Wallet and referrals
Where available, your account may include an in-app wallet usable toward renewals and upgrades. Wallet credit is not cash, is not withdrawable, and cannot be transferred to other users except as explicitly allowed by the referral or billing flows we operate.
Referral rewards (if offered) are granted according to the program rules in effect at the time of a qualifying conversion. We may withhold or reverse credits obtained through abuse, self-referral, or fraud.
8. Organizations, teams, and access control
If you use Organizations and Teams, you are responsible for who you invite, which roles you assign, and which servers / sites they can access. Invited members must comply with these Terms. Ownership transfers and member removals are controlled by the account owner (or roles you configure).
9. Support ticketing
In-app support tickets are subject to plan-based creation caps, anti-spam reply rules, and a limited reopen window after closure (typically 72 hours). Attachments must be appropriate and free of malware. Abuse of the ticketing system may result in limits or suspension.
10. Availability and maintenance
We aim for high availability of the DMS Panel application but do not guarantee uninterrupted or error-free service. Scheduled maintenance will be communicated in advance where practical.
Uptime of the Linux servers you connect is between you and your hosting provider. Network issues, SSH failures, or misconfiguration on those hosts are outside DMS Panel’s control.
11. Intellectual property
DMS Panel software, branding, UI, documentation, and related materials are owned by us or our licensors. You receive a limited, non-exclusive, non-transferable right to use the Service during your subscription in accordance with these Terms. You may not reverse engineer, scrape, or copy the Service except as allowed by mandatory law.
12. Disclaimers and limitation of liability
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunity, arising from your use of the Service — including data loss or downtime on a connected server resulting from actions you, your teammates, or automated jobs perform through the panel.
Our aggregate liability arising out of these Terms or the Service will not exceed the amounts you paid to us for the Service in the three (3) months before the claim (or ₹5,000 if you are on Lifetime Free), except where liability cannot be limited by law.
13. Suspension and termination
We may suspend or terminate access immediately for Terms violations, non-payment, security risk, or legal requirement. You may stop using the Service and delete your account at any time subject to our data-retention practices described in the Privacy Policy.
Upon termination, your right to use the Service ends. We are not obligated to retain or export your panel metadata beyond what the Privacy Policy requires, though you remain free to retain copies of data on your own servers.
14. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated by email and/or an in-app notice before they take effect. Continued use after the effective date constitutes acceptance of the updated Terms.
15. Governing law
These Terms are governed by the laws of India, without regard to conflict-of-law principles. Courts in India shall have exclusive jurisdiction over disputes arising from these Terms, subject to any mandatory consumer protections that apply in your place of residence.
